Defendants petitioned for reconsideration the Court's decision in Ride PDX v. Tee & B, LLC, 322 Or App 165 (2022), alleging that there were four factual errors in the opinion. Defendants argued that these errors left the holding without a factual basis and summary judgment should have been granted in their favor. The Court agreed with Defendants that the record did not support a particular statement having been made and modified the opinion to delete the last two sentences of the first full paragraph at 322 Or App at 180, accordingly.
