Under OAR 661-010-0015(3)(f)(B), a party filing a notice of intent to appeal (NITA) with LUBA must include the name of the local government’s counsel.

Petitioner filed a notice of intent to appeal (NITA) with LUBA regarding a County approval of an exception to Statewide Planning Goal 4 on a particular property. LUBA notified Petitioner that their NITA did not include the name of the County’s counsel as required under OAR 661-010-0015(3)(f)(B), and gave Petitioners seven days to amend their NITA. When the seven days had passed and the NITA had not been amended, LUBA dismissed the appeal.

Dismissed.
